Congress makes the laws regarding the border. The GOP wants it both ways- they don't want to pass laws to put into effect what they want at the border. They want to have Biden do it unilaterally so they can continue to complain and use it as a wedge issue.

Biden offered to compromise in December and the GOP instead went home.
